MODEL RELEASE: I hereby grant and assign "Elizabeth Buccheri Photos" and is legal representatives the irrevocable and unrestricted right to publish photographs of THE CLIENT or in which THE CLIENT may be included for editorial, advertising or any other purpose and in any manner or medium to alter the same without restriction; and to copyright the same. THE CLIENT hereby releases "Elizabeth Buccheri Photos" and its legal representatives and assigns all claims and liability relating to said photographs. Its agreed that "Elizabeth Buccheri Photos" will not display and use the photographs taken for advertising displays, website and internal promotion, photographic contests, public display such as malls, photography books, photography instructional books, store fronts, window displays, studio displays, television advertising, magazine advertising and any other purpose thought proper by "Elizabeth Buccheri Photos" without THE CLIENT written consent. THE CLIENT hereby grants "Elizabeth Buccheri Photos" consent to photograph objects or subjects during session. LIMIT OF LIABILITY: In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer or studio. "Elizabeth Buccheri Photos" will make every effort to secure a replacement photography and/or studio able and/or willing to provide similar package as chosen at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the photographic package selected in this contract. "Elizabeth Buccheri Photos" takes the utmost care with respect to exposure, transportation and processing of photographs; including using equipment and grade back-up equipment. However, in the unlikely event THE CLIENT photographs being lost, stolen, or destroyed for reasons within "Elizabeth Buccheri Photos" control, the latter's liability is limited to the return of payments received for the photographic package selected in this contract. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be prorated amount of the exposure lost bases on the percentage of the total number originals. NON-GUARANTEE: Although every possible care will be taken to product photographs of all importance during the session, "Elizabeth Buccheri Photos" cannot place an unconditional guarantee on the above. "Elizabeth Buccheri Photos" will not be held responsible for any ruined photographs outside of "Elizabeth Buccheri Photos" reasonable control. PERFORMANCE: The performance of this contract on behalf of "Elizabeth Buccheri Photos" shall be contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by supplies, and/or conditions beyond its control. PROOFS: "Elizabeth Buccheri Photos" will send a proof gallery will be sent where Client will select the photos they would like "Elizabeth Buccheri" to edit and deliver. PHOTOGRAPHY DELIVERY: "Elizabeth Buccheri Photos" agrees to edit all final images and deliver via online gallery using the email address provided in signing this form and to be given to clients within the agreed time frame. RELEASE: All photos are immediately granted a printing copyright release and include unlimited printing rights for THE CLIENT professional and personal use. SESSION/PRODUCT FEE: THE CLIENT agrees to pay full invoice amount within 5 days of receipt. All invoices will be send through an online portal (honeybook.com) and will need to be paid online.
